General Conditions of Carriage

Scope of application

These General Conditions of Carriage form the basis for the carriage of passengers and freight, including the related services, by IAS Itzehoer Airservice GmbH (hereinafter referred to as IAS, "we" or "us").

IAS is entitled to transfer the performance of the transport services in whole or in part to third parties / vicarious agents, provided it is ensured that their safety standard corresponds to that of IAS and the flight is operated by a service provider of equivalent quality.

Booking / Payment

The passenger confirms with his booking to be legal of age or by a legal guardian to be entitled to this booking.

The booking is only valid for the booked flight and for the person named in the booking. In the course of the booking process, the actual name and surname of the passenger (s) must be indicated with an official photo ID or substitute document. Indication of fantasy names or fictitious name designations is inadmissible.

If one or more passengers are booked by one of the applicants, this person is responsible for the correct and prompt transmission of messages to passengers booked by him. He has to compensate IAS for the loss resulting from a non-prompt, correct forwarding of notifications.

Diligence obligations of passengers

Passengers are required to provide their contact details so that they can be informed about changes to flight times and flight cancellations in good time.

The passenger is required to pick up the checked baggage as soon as it is ready for collection at the airport of destination or at the place of the flight interruption. If the passenger does not accept the baggage immediately, IAS may charge the passenger for storage fees.

Price / increase of costs

The prices confirmed with the booking apply only to the carriage from the actual departure to the destination for the person named in the travel or booking confirmation and the mentioned flight times.

Behavior on board

The passenger must follow the instructions of the persons responsible for the flight, in particular the pilot.

Electronic devices on board

The unauthorized operation of electronic devices on board, e.g. mobile phones, laptops, CD players, electronic games and broadcasting devices, radio toys and walkie talkies are prohibited and may be punishable by law. Exceptions to this are hearing aids and pacemakers.

Dangerous goods on board

Dangerous goods are substances and objects which, by virtue of their nature, their properties or their condition in connection with carriage, present risks to public safety and order, in particular to the general public, to important common goods, to the life and health of humans and animals and others Things can go out.

Data protection

IAS collects passenger data as part of the settlement of flight bookings and flights. IAS processes personal data in accordance with the provisions of the EU Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). Without the consent of the passenger, IAS will not use the Passenger's data for advertising, market or opinion research purposes. Passengers have the option of receiving IAS information about their stored data at any time.

Personal data are used by us to fulfill contractual obligations in accordance with Art. 6 para. 1 sentence 1 lit. b) GDPR processed. This includes in particular:

  • Issuing a plane ticket
  • Sending a booking confirmation
  • providing flight related services booked by you and flight related information, e.g. catering, luggage services
  • Handling the check-in process from invitation to waiting list processing and baggage handling.

In addition, we process your data in order to safeguard our legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f) GDPR:

  • to provide you with relevant information about your booked flight and destination
  • for the purpose of preventing fraud, e.g. Credit card misuse, identity fraud, elimination of special conditions or tariffs
  • to assert legal claims including debt collection and defense in case of legal disputes
  • for revision purposes
  • to ensure the IT security and IT operations of the airline
  • to ensure flight safety

Liability

Transport is governed by Regulation (EC) No 2027/97, as amended by Regulation (EC) No 889/2002.

In the case of the contributory negligence of the injured party to the occurred damage, the norms of the applicable law with regard to the exclusion or the reduction of the obligation to pay compensation apply with the contributory culpability of the injured party.

IAS cannot be held liable for any damage that results from compliance with government regulations or from failing to meet the obligations of these regulations.

The liability of IAS in no case exceeds the amount of proven damage. IAS is only liable for indirect or consequential damages if IAS has caused them grossly negligently or intentionally; the provisions of the Montreal Convention remain unaffected.

Unless otherwise expressly provided, none of these General Conditions of Business and Carriage contain any waiver of IAS disclaimers or limitations under applicable law.
